The Real Housewives of New Jersey’s most controversial resident Danielle Staub has been embroiled in a federal defamation lawsuit filed by her ex-husband Kevin Maher for months, and it looks like it’s definitely going to trial.

RadarOnline.com has learned exclusively that all parties were in settlement negotiations Wednesday but were unable to come to a mutual agreement and the negotiations abruptly fell apart.

"The mediator Gary Donovan tried all day for a settlement and the other side jerked us around,” Maher told RadarOnline.com exclusively.

“We tried to settle this in good faith and negotiations failed. We are going to trial!”

Staub’s lawyers had filed a motion Tuesday requesting to exclude certain evidence from trial regarding Staub’s criminal history, Maher’s polygraph examinations, any references to Staub’s extra-marital sexual history, the testimony of Daniel Aguilar, and Caroline Manzo’s deposition testimony.
Staub’s attorney Peter Cook outlined 29 points in his motion requesting to prohibit certain evidence, including the following: any depictions of Staub as either a stripper, prostitute or cocaine addict by Maher; any use of video footage from The Real Housewives of New Jersey, any use of Staub’s book The Naked Truth; any and all references to her criminal history, sexual history; and any references to her past or present illegal drug use and sex tapes featuring Staub.
And when it comes to Danielle’s former reality co-stars, Cook requested the exclusion of all references to Danielle’s relationship with Dina Manzo, Teresa Giudice, Jacqueline Laurita, and Danielle’s interactions at The Brownstone owned by Caroline Manzo. Also, any references made by Caroline regarding Danielle’s reputation, alleged outstanding debts, and alleged deceitful acts.

Staub is scheduled to be deposed in the case on October 5 and Maher says it may have been a motivating factor to discuss a settlement.

"I believe that October 5 would be the worst day in Danielle Staub's life, worse than her arrest,” Maher told RadarOnline.com regarding the possible reason Danielle’s lawyers and Simon and Schuster (that published her book The Naked Truth) were attempting to settle.

Although Maher is disappointed in today’s outcome, has plans to take further legal action against the Real Housewife and those affiliated with her book.

“The mediator was talking to everyone involved so this didn't have to go to court and so I could put this behind me and she could put this behind her."

“What her lawyers did today is going to get Danielle sued twice! Danielle Staub with writer Steven Prigge and Simon and Schuster will be named as defendants in an upcoming lawsuit to be filed next week.”

Calls to attorneys for Danielle Staub were not returned.

Real Housewives of New Jersey trouble-magnet Danielle Staub doesn't want to be called a prostitute or a stripper.

But ex-husband Kevin Maher tells E! News that he plans on revealing much worse about the reality star...

Staub filed a motion Tuesday asking the judge in Maher's defamation case against her to specifically exclude "any evidence that the Defendant was a prostitute, or a stripper, or is promiscuous, or has been featured in sex tapes."

But despite Staub's attempts to have her alleged sexual history excised from the record, Maher is fighting it, saying the dirty info he has on her will prove she is a "pathological liar."

"Since this woman put these serious rape and molestation charges against me, [information about her past] is relevant...What this woman has done to me…I can't even describe how she has ruined my life. She's without conscience."
Maher is suing Staub for $5 million over her accusations that he raped her on broken glass, hung her dog, and played Russian roulette with her lady parts.

"She lied from day one and I'm going to prove that she's a pathological liar," says Maher.

Staub is due in court Oct. 5 to give her deposition in the case.

"She's been ducking and hiding from her deposition since this lawsuit has been filed," says Maher. "Oct. 5 will be the worst day of her life, when she is confronted under oath with all her lies. She's going to be destroyed."

Maher and Staub's Housewives costar Caroline Manzo have both already been deposed. The trial is set for February.

It's all over the $5 million defamation suit the former "Real Housewives of New Jersey" star's ex-husband Kevin Maher filed against her -- claiming she falsely accused him of raping her on broken glass, sticking a loaded gun in her privates, and murdering her dog.

According to the new docs, obtained by TMZ, Staub wants to make sure any evidence depicting her as "a prostitute, or a slut, or a whore" -- including her sexual history and sex tape -- is excluded from the trial.

In the papers, Staub claims her dirty laundry would turn a jury against her.

Oddly, the motion to exclude makes no mention of her performance on 'Housewives.'

Danielle Staub may actually be taping something that isn't scripted next month, and it contains allegations of rape, gunplay and animal murder.

TMZ has learned the former "Real Housewives of New Jersey" star is set to spill her guts in a videotaped deposition in her bitter legal war with her ex-husband Kevin Maher.

As we previously reported, Maher is suing Staub for $5 million -- claiming she damaged his reputation by falsely claiming he killed her dog, raped her on a bed of broken glass and stuck a loaded gun into her genital region.

Staub has denied ever making those claims in the first place -- and argued that Maher's reputation is already so damaged ... that she shouldn't have to fork over a dime.

Real Housewife of New Jersey Caroline Manzo has been dragged into her cast mate Danielle Staub's ongoing court battle with her ex-husband, and RadarOnline.com has the exclusive document detailing her involvement with the case.

The red-headed NJ Housewife who has openly talked about her disdain for Danielle on - and off - the show was recently deposed in a Federal defamation lawsuit filed against Danielle by her ex-husband, Kevin Maher.

At one point during her deposition, Manzo recounted the tales Danielle told her about her sordid married past in which Danielle claimed to have hid from Maher in a tree, claimed she was forced by him into prostitution, and how she feared for her life.

"She depicted him as a monster," Manzo recalled during her July 22 deposition. "She depicted him as someone who would beat her daily, as someone that put her in the hospital due to the beatings, I want to say on more than one occasion."

Manzo was deposed on behalf of Maher in an effort to help prove his defamation claim against Danielle. Maher claims the former Real Housewife of New Jersey star made damning allegations to other people about him, including that he raped her on broken glass, hanged or shot her dog, and that he inserted a gun into her and played Russian roulette.

Under oath, Manzo recalled statements allegedly made by Danielle and they appear to confirm Maher's claims. "She told a story about being raped on broken glass. One incident, she said that he shot her dog. And then another incident she claimed that he hanged her dog. I'm confused as to whether this all was at the same moment of the rape on the glass with the dog, and inserted a pistol up her vagina and played like a Russian roulette."

Manzo continued, "She claimed to have been hiding in a tree at some point, afraid that when he came home he would find her and beat her. She claimed to be the victim of prostitution due to his demands, that he put her into that world, again depicting him as an absolute monster. And the only reason she stayed with him, because she feared for her life if she left."

"Again it was just a picture of an absolute monster, that she was under his control... anything that she did during the course of her relationship with Kevin Maher was not of her own freewill; it was more or less a domineering person."

Danielle has filed a motion with the court to dismiss the case which will be heard on September 27.

"The Real Housewives of New Jersey's" Danielle Staub's legal team spent close to 10 hours on Friday, August 27 with her ex-husband Kevin Maher's attorney to try and settle his $5-million defamation case against the housewife with no results.

Monday (August 30), TMZ reported that her team filed a motion to dismiss the case claiming Maher had no witnesses to prove she made slanderous statements, that he is a sexual deviant, and saying that his reputation while working as a police informant and during their brief marriage as revealed in the book he co-authored, "Cop Without A Badge," makes him an unreliable person.

"It's just a B.S. motion," Maher tells Zap2it exclusively. "It's not going to work. It's just another way for her to get headlines. Some of the things I wrote about myself, I wasn't proud of, but most of them I was. I was honest. I put it out there. These are things that took place 25 years ago."

He continues, "What I'm suing Danielle Staub for ... it's not about something that happened 25 years ago. It's about something that happened in June of last year."

In fact, Maher says that there are items in Staub's motion that are simply untrue and believes the motion will be thrown out as soon as Tuesday.

First, the motion claims that Maher couldn't produce a witness who can testify that Staub made false statements about him. He tells us that cast member Caroline Manzo testified that Staub told her while other cast members were present that he "had raped her on broken glass, that I inserted my gun in her and played Russian roulette and that I had hung her dog." Then "on a different occasion that the mechanism of murdering her dog was with a gunshot so there were two variations of how I killed her dog."

Maher believes Staub's motions are meant to stop him from interviewing witnesses who can further prove her allegedly slanderous statements, such as Mark Dagostino, a People Magazine writer who she allegedly told the statements to and Staub, herself, who has yet to be deposed.

Second, Maher says that Staub's motion misquotes the deposition he made to her attorney and recorded in legal transcripts. For example, Staub's legal papers allege that Maher "stated that if it was possible that he blacked out on one occasion, it is possible he blacked out and raped Ms. Staub, but just could not remember doing it."

Maher sent Zap2it excerpts from the legal transcript of his deposition. According to those excerpts, Maher's stated in his deposition, "I blacked out one time. I don't know if blackout would be the right phrase, but I couldn't remember what -- what tunnel or bridge that I took home. But no, I -- no, raping someone on a bed of broken glass would be an act that I would never forget."

And as far as Staub's accusation that he's a sexual deviant? "I've never done anything sexually deviant with any woman in my life," he says. "And for her to call me a sexual deviant is another slanderous move on her behalf. I'll throw that in my lawsuit, too."

Danielle Staub is going after her ex-husband with a vengeance -- claiming the guy is such a drug-abusing, violent, sexual deviant ... that his $5 million defamation lawsuit against Danielle should be thrown out of court.

Danielle just filed legal papers -- in which she states that Kevin Maher has "no evidence" that Danielle ever made several controversial statements about him ... including accusations that Kevin killed her dog, forced her to play Russian Roulette ... and even raped her.

As we previously reported, Maher filed a lawsuit against the "Real Housewives of New Jersey" star -- claiming she did make the alleged statements ... and in doing so, she damaged his reputation to the tune of $5 million.

But Staub claims Maher has admitted to being such a scumbag in the past -- that even if she did make the statements, his reputation couldn't suffer any worse than it already has.

In fact, Staub lists several examples of Maher's alleged scumbaggery ...

According to the docs, Staub claims it's all spelled out in Maher's infamous biography, "Cop Without a Badge" ... in which Maher admits to using cocaine, has "overactive sexual proclivities," and once shoved a gun into the genitals of a man he thought was sleeping with Danielle.

As TMZ previously reported, Maher and Staub are attempting to settle their issues through mediation ... but in case that fails, the case is set to go to trial in February.
